What Is Legal Studies?

The law is essentially a set of rules that govern the behaviour of a society. It prescribes what we can or must do - and what we cannot do. In most human activities there are rules, written or unwritten, that guide us in our actions. These rules may be rules of etiquette, which dictate polite behaviour, rules of a sport such as soccer, or more serious rules such as those involved in criminal law.

For a society to operate peacefully and fairly (with stability and order), rules or laws are necessary to encourage behaviour that is acceptable to society. If it were up to the individual to decide what rules are fair, some individuals may decide that theft and murder are acceptable and behave accordingly while the majority would like to be protected from such acts. The absence of laws would lead to chaos.

Legal rules are made by the representative leaders of the population in a nation. This is the government. These rules are prescriptions on what people may do, must do and must not do. They reflect a consensus of ethical rules and rules of morality. Legal rules can be distinguished from ethical rules and positive morality by the legal application of sanction or punishment.
